In this book you are holding, you will find a preliminary solution to the question of the applicable law governing litigation faced by banking institutions located in the CEMAC zone during collective liquidation proceedings initiated against them. Indeed, litigation arising from bank liquidation is subject to a dual legal framework consisting of OHADA provisions and COBAC regulations. This simultaneous application stems, on the one hand, from the fact that banks may exist only as corporations and only after obtaining approval from COBAC. On the other hand, this dual application also arises from the fact that the parties called upon to participate in the liquidation proceedings are subject to both sets of rules. Given this observation, it is important to clarify the simultaneous application of OHADA's general law and COBAC's special law regarding bank liquidation proceedings.
