Since 2017, the private sector in the Democratic Republic of the Congo has been governed by a law establishing the rules applicable to subcontracting. This law was recently amended and expanded in 2026. Since its enactment, the application of this new law has been the subject of several controversies. The regulatory authority established under the law has been the source of various interpretations, some of which have created confusion regarding the law's application, leading to its amendment in 2026. However, the mining sector, governed by the 2018 Mining Code and its accompanying mining regulations from the same year, operates under a specific regime that differs from the provisions of the 2017 law. The analysis presented in this work aims to demonstrate the distinct nature of mining law relative to the general framework governing subcontracting. The specific definition of actors and activities provided in the mining sector should be considered as defining subcontracting in the private sector. The appendix to this work lists the activities that the subcontracting authority considers to fall under the scope of subcontracting.
